NEW BUSINESS

Bill Roper – Land Trust questions – Kate Lampton, Joya Kuss, Rick Quenneville – Champlain Valley Conservation District and Middlebury Area Land Trust are working on a joint project to purchase lots on the east side of Rt. 7 from the Quennevilles. They are also currently talking with Misty Knoll to exchange development rights on their land for use of the Quenneville property.  Looking to get some funding from the Vermont Housing Conservation Grant Program and would like a letter from the town stating that the project meets the Towns goals.  Allen concerned about keeping the land mowed if conserved. Lampton – Groups are interested in preserving the view from Rt. 7 and would put covenants in the deed that land needs to be mowed. Discussion of any change to tax base.  Land would stay in the current use program so tax base would remain the same.  Discussion – Tax dollars paying for purchase.  Most money comes from private donors.  Grant money comes from property transfers.  Roleau expressed concern that money does not come from taxpayers. 

 

Discuss steel building 40 by 120 on Quenneville property selectboard given permission to take building.  Busier will go look at it.  Will need building permits to move.

 

  • Rick Pollack – Road Access problems – Allen looked at access after last meeting; Pollack had not finished changes at that time.  Pollack has now moved the driveway to the south and brought up to road level.  Busier requested 30 by 30 foot area by road.  Discussion of distances to nearest curve / hill – Pollack stated it was 170 feet from drive to phone poll where road drops off. Turn is another 50 ft beyond that.  Allen expressed concern for town’s liability. Roleau expressed interest in resolving the situation.  Pollack suggested that the Planning Commission not issue subdivisions to lots where there is no safe access.  Discuss changes in Zoning Administrator and problem of a building permit being issued prior to the road access permit.  Allen will go look at driveway again.

 

  • Liquor License – Greg West – Rt 7 Restaurant and Pizzeria – Returned to report on insurance issues discussed at the last meeting.  He has spoken with his insurance carrier and they have said he is covered for alcohol service.  Discussion of family oriented activities and alcohol related business happening at the same time.   Selectboard requested a letter from the insurance company stating coverage for alcohol (beer, wine and liquor), go carts and banquet facility all at once.  Discuss potential septic issues.

 

 

  • Appoint Emergency Manager  - on hold

 

Heffernan’s – Concerned about towns initial response to there act 250 questionnaire.  Gravel pit is really in Bristol, with a tiny section in New Haven off of Plank Rd.  Discussion of problems with road breaking up from loaded trucks.  May need help with gravel/maintenance of road.  Allen didn’t see problem if can come to agreement about gravel for road upkeep.  Busier will go look at road and estimate needs. Heffernan’s will send a new act 250 questionnaire. 

 

 

ROAD CREW UPDATE

  • Road Access Permit – Martell – Discuss problems with land for building on – When was lot subdivided?  However access point is O.K.   Signed permit.

Discussion of resurfacing roads next year rather then paving new.

Fred Nicholson is coming on Sept. 11 to look at trees in river from storm.

  • Speed Limit / Road Access Policy  -no action
  • Sign pay orders - signed

 

MISC.  CORRESPONDENCE

  • Madden - Request / petition to have Planning Commission, Zoning Board and School Board be town residents. – Petition is confusing -   Signatures are copied rather then originals and it is not clear if people knew what they were signing due to signature pages on paper with no other writing.  Selectboard has no authority to override the state statues – School board is elected and required to be resident of town.  Discussion – selectboard does not have problem with putting a more clearly written article on the warning for town meeting. 
  • Ouimette – Meeting on Sept. 2, at 10 am to discuss Zoning Procedures. No action taken. Discuss building located at jct. of route 7 and 17 needing a conditional use permit.  Discuss zoning area as RA-10.
  • Department of Public Safety – Approved public assembly permit for Northeast Mud Drag Sept. 6 and 7,  2003
  • Velco – Petition to enlarge power lines and substation. – Related documents – On going many documents
