Notice of adoption of ordinance
For Traffic, Speed and Unpaved Town Roads
Notice is hereby given of the ordinance for the control of Traffic, Speed and Unpaved Roads for the Town of New Haven, adopted at the Select Board meeting on March 30, 2004and amended on November 16, 2004.. Citizens have the right to petition for a vote on the ordinance at an annual or special meeting as provided in Section 1973 of Title 24. Unless a petition is filed for a permissive referendum within 44 days of the adoption of this ordinance, this ordinance will become effective January 15, 2005 which is sixty (60) days after the date of its adoption.
TOWN OF NEW HAVEN
TRAFFIC ORDINANCE
ARTICLE 1. AUTHORITY. This ordinance is adopted by the Town of New Haven under authority granted by 24 V.S.A. Chapter 59, 23 V.S.A. Sec. 1007, and 24 V.S.A. Sec. 2291 (4).
ARTICLE 2. PURPOSE. The purpose of this ordinance is to promote public safety.
ARTICLE 3. SEVERABILITY. If any portion of this ordinance is held unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected.
ARTICLE 4. SPEED REGULATIONS. A maximum speed of 40 miles per hour shall be established for the following roads.
a. Pearson Road: Starting at the New Haven / Weybridge town line and proceeding north for approximately 5 miles.
b. Field Days Road: Starting at the junction of Field Days Road and Route 17 and proceeding west to the New Haven / Weybridge town line.
c. North Street: Starting approximately .5 miles north of the junction from Route 17 and North Street and extending north approximately 3 miles.
d. South Street: Starting .5 miles south of the junction of South Street and Route 17 and extending south approximately 2.5 miles.
e. Dog Team Road: For its entire length, approximately .75 miles.
ARTICLE 5. PENALTIES.
a. This shall be a civil ordinance which shall be enforced in accordance with the provisions of 24 V.S.A. Chapter 59 or through any Vermont court having proper jurisdiction.
b. The penalty for violation of any of the above speed limits shall be that set by the schedule of fines set by the State of Vermont.
ARTICLE 6. ENFORCEMENT OFFICIALS. This ordinance may be enforced by any sworn member of the Addison County Sheriff’s Dept. as well as any properly qualified law enforcement officer in the State of Vermont.
ARTICLE 7. EFFECTIVE DATE. This ordinance shall become effective 60 days after its adoption by the Town of New Haven Selectboard. If a petition is filed under 24 V.S.A. Sec. 1973, that statute shall govern the effective date.

SPEED LIMIT ON UNPAVED TOWN ROADS
ARTICLE 1. AUTHORITY. This ordinance is adopted by the Selectboard of the Town of New Haven under authority granted by 24 V.S.A. Sec. 2291 (4) and 24 V.S.A. Chapter 59.
ARTICLE 2. PURPOSE. The purpose of this ordinance is to promote public health and safety by establishing safe seed limits on all unpaved town highways in the Town of New Haven.
ARTICLE 3. SPEED REGULATIONS. Based on consideration of neighborhood character, abutting land use, bicycle and pedestrian use and physical characteristic of the highways. The following speed limit is established.
A speed limit of 35 miles per hour for all unpaved roads.
This speed limit shall be posted in accordance with standards set forth in the Manual of Uniform Traffic Control Devices.
ARTICLE 4. PENALTIES.
a. This shall be a civil ordinance which shall be enforced in accordance with the provisions in 24 V.S.A. Chapter 59 or through any Vermont court having proper jurisdiction.
b. The penalty for violation of the above speed limit shall be set by the schedule of fines established by the State of Vermont.

Certification:
On March 30, 2004 the New Haven Town Selectboard met at New Haven and, upon consideration of the facts and engineering traffic investigation, determined that the maximum speed limit of fifty miles per hour is greater or less than is reasonable and safe under existing conditions on the highway described below and have determined and declared a reasonable and safe speed limit on said highway which shall henceforth apply as follows.
River Road shall have a speed of 40 MPH beginning at the junction of Route 7 and River Road and proceeding in an Easterly direction for approximately 4.7 miles.
Town Hill Road shall have a speed of 40 MPH starting at the junction of Town Hill Road and Route 7 and continued in an easterly direction for approximately 1.7 miles.
And that the Town of New Haven shall forthwith erect signs on said highway giving notice of such speed limit in form to conform to the Manual of Uniform Traffic Control Devices.
